In almost every state and city we see severe budget deficits, unsustainable pension costs, heavy taxes, cumbersome regulation, and distressed public schools are but a few of the challenges that policymakers must address for our nation to remain a beacon of business innovation and economic opportunity. We must come to grips with the  flawed policy plans that are displayed and analyzed by a diverse set of so-called "experts" as they work to change this nation is ways from which we will not soon recover.  And yes,Truth Hurts -- Federal government is already twice as bankrupt as the city of Detroit.

Before it is too late "... Americans should avail themselves of the opportunity to press members of Congress while they are home on recess to stop the administration’s usurpation of powers through regulation. Ultimately, citizen activists must convince Congress to abolish the unconstitutional agencies that threaten our continued existence as a free people."  This is a major part of the equation for our national survival. Obama EPA War on Coal to Shut 200+ Coal-Fired Plants, Devastate Economy

America is staring at a fast-approaching energy disaster that needn’t happen. The recent discovery and development of vast deposits of oil and natural gas, now recoverable with new technologies, have provided the U.S. economy with a much-needed boost over the past several years. These new energy sources also offer promise of increasing America’s competitive advantage by drastically lowering energy costs and reducing American dependence on foreign oil. This is of critical importance to luring manufacturing and industry back to the United States.

However, coal, one of our most abundant and important sources of energy, will remain a major component of any viable energy scheme for the United States. According to the federal Energy Information Agency (EIA), 45 percent of the country’s annual four trillion kilowatt-hours of electricity are generated from coal. And, says the EIA, we have a Demonstrated Reserve Base of 496 billion short tons of coal, of which 272 billion tons are considered recoverable with current technology. With U.S. usage at 1.1 billion tons per year, we have about 250 years’ supply at the present rate of consumption.

President Obama, however, has taken the path of the most extreme environmental radicals and declared war on coal. Since he has not been able to get Congress to enact legislation to destroy the coal industry, he is unconstitutionally using the EPA to regulate coal into extinction. 

On August 2, the Reuters news service provided a list of 207 coal-fired plants that are scheduled to close. A May 2 news release from the American Coalition for Clean Coal Electricity (ACCCE) puts the total of coal-fired plant closings even higher, at 285, in 32 states.

If Congress does not restrain the EPA’s regulatory binge, Americans will be hit not only with much higher electricity prices, but also with brownouts and blackouts, especially during the cold winter months and hot summer spells, when heaters and air conditioners put the squeeze on power grids. Warnings of potential brownouts and the need for the public to ease up on air conditioning, as issued recently in Boston and New York, will become commonplace if coal is banished as an energy source.

Barack Obama’s antipathy toward coal is no secret. During his first presidential run, in 2008, candidate Obama let it be known that his plan was to bankrupt the coal industry with huge fees and impossible-to-comply-with regulations, all under the pretext of saving the planet from the discredited threat of global warming. Then-Senator Obama told the San Francisco Chronicle: “So if somebody wants to build a coal-powered plant, they can. It’s just that it will bankrupt them because they are going to be charged a huge sum for all that greenhouse gas that’s being emitted.”

[....] Gina McCarthy “Fuel-switching” Tactic: Natural Gas vs. Coal

Leading the FedGov regulatory blitzkrieg on coal is the EPA. Things are not likely to improve there under Gina McCarthy, Obama’s newly appointed EPA administrator, who was confirmed by the Senate in July, on a 59-40 vote. In a June 26 story for CFACT (Committee for a Constructive Tomorrow), Dr. Bonner Cohen reported

In 2012, the Obama EPA issued its “new source performance standard” that effectively made it impossible to build new coal-fired power plants, because no technology exists that would enable utilities to meet the new standards. At the time, the head of EPA’s air office, Gina McCarthy, assured the public that existing plants would not have to meet the new standard and that EPA was not promoting fuel-switching. Less than a year after McCarthy’s solemn promise, however, the following sentence appears on page 19 of Obama’s Climate Action Plan: “Going forward, we will promote fuel-switching from coal to gas for electricity production and encourage the development for a global market for gas." 

Dr. Cohen points out: “While natural gas extracted from America’s vast shale formations will be able to fill some of the gap, the elimination of coal as a power source will put huge strains on the already weak economy and on household budgets.” 

More importantly, as Dr. Cohen warns, the enthusiasm for natural gas expressed by many greenies is a cynical ploy, intended to ease the demise of coal. But once coal is shut down, the greens will turn their sights on gas and oil. Cohen writes: 

And what is to keep the war on coal from morphing into a war on gas? While most Americans welcome the jobs and lower power rates the Shale Revolution has made possible, the Obama administration and its allies in the environmental movement remain firm in their hostility to fossil fuels. After coal has been regulated out of existence, green elites will not hesitate to go after natural gas and oil. EPA bureaucrats and Obama administration political appointees are already devising schemes to bring about federal regulation of hydraulic fracturing, better known as fracking. 

Congress Is the Key

As The New American has reported previously ("Obama Eyes 'Executive Orders' to Circumvent Congress"), President Obama is pursuing a path of rule by executive fiat, relegating Congress to irrelevancy. He has shown by word and deed that he intends to implement his agenda by executive orders and agency rule-making, disregarding all constitutional constraints.

Between January of this year and the August recess, Congress enacted 22 laws. By contrast, the federal government’s website for information on the non-stop avalanche of federal rules and regulations, informs us that unelected, unaccountable bureaucrats have posted thousands of new rules and regulations — in just the past 90 days! According to www.regulations.gov (as posted on August 8), the following onslaught is currently in the pipeline:

It is worthwhile to pause to reflect on those figures for a moment or two. In a little over seven months, Congress passed 22 pieces of legislation. Meanwhile, federal bureaucrats saddled the country with 6,571 regulations, rules, interpretations, and administrative dicta — in just 90 days! The Obama administration’s war on coal is but one front, albeit a major one, in an all-out revolutionary assault on the rule of law, that is transforming what remains of our constitutional republic into a dictatorship. 

The Unconstitutional Fourth Branch of Government

As we noted last year in “Danger: Federal ‘Regulatory Cliff’ Ahead”

The very first sentence of Article I, Section 1 of the U.S. Constitution states:All legislative powers herein granted shall be vested in a Congress of the United States.” It is difficult to get more plain and definitive than that: “All legislative powers.” Congress is the legislative branch, and it possesses “all legislative powers.” The executive and judicial branches have their own peculiar jurisdictions and purviews, but their powers do not include lawmaking. Nor does the Constitution allow the Congress to sublet or delegate its lawmaking authority to the president, bureaucrats, or judges. Moreover, Congress has only those legislative powers “herein granted,” which means, of course, that Congress may not legislate on whatever its members may wish, but only regarding those particular matters granted by the states in the Constitution.

Nevertheless, Congress (and the American people, whose duty it is to vigilantly monitor Congress) has allowed the executive branch to stealthily, steadily build an enormous fourth branch of government — the federal regulatory leviathan — that has usurped legislative, executive, and judicial powers. According to our Founders, this is “the very definition of tyranny." 

James Madison, frequently referred to as the “Father of the Constitution,” addressed this issue in essay No. 47 of The Federalist, noting: “The accumulation of all powers, legislative, executive, and judiciary, in the same hands, whether of one, a few, or many, and whether hereditary, self-appointed, or elective, may justly be pronounced the very definition of tyranny.

Constitutionalists who are determined to stop America’s devolution into administrative tyranny should avail themselves of the opportunity to press members of Congress while they are home on recess to stop the administration’s usurpation of powers through regulation. Ultimately, citizen activists must convince Congress to abolish the unconstitutional agencies that threaten our continued existence as a free people.

The Green Crusade Goes National
The tried and true formula underlying Obama's climate speech

Having grown up on a farm in California's San Joaquin Valley, I have seen firsthand how environmental extremists smashed a flourishing agricultural region. Citing the need
to protect a three-inch baitfish called the Delta smelt, green activists succeeded in getting farmers' water supplies drastically cut. As some of the world's most productive soil degenerated into a drought-stricken landscape, farmers - some of whose families had worked these lands for generations - packed up and left. The local economy sank, with unemployment in the Valley now doubling the national average.

President Obama's recent speech unveiling his "new national climate action plan" - with its centerpiece proposal to begin regulating carbon emissions from power plants - shows this extremist agenda being applied nationwide. All the key elements we have seen in California are there - the doomsday demagoguery, the brazen dishonesty about the policy's economic effects, the breezy dismissal of democratic norms, and other deceptions large and small. The following is a partial list:

Scaremongering. In the days leading up to Obama's speech, the press was full of reports about the dramatic decline in the pace of global warming over the past 15 years. Some climate-change Cassandras, most notably The Economist, suggested this could imply inaccuracies in the computer modeling that underlies the "scientific consensus" on global warming.

But Obama's speech contained no hint of this debate, no clue of skepticism or doubt. Ridiculing his opponents as part of a "Flat Earth Society," Obama cavalierly invoked an array of weather events - hurricanes, droughts, wildfires, heat waves - to prove the need to completely transform our economy and our way of life in order to fight global warming. The fact that these kinds of weather events predate the Industrial Revolution apparently did not impress the president.

"Ultimately," Obama intoned, "we will be judged as a people, and as a society, and as a country" by what we do about this issue. With that declaration, he identified global warming as the single most urgent issue of our time. This alarmism is a staple of every green crusade of the past half century - acid rain, overpopulation, resource depletion, global cooling (remember that one?), deforestation, etc. Every green campaign is said to be crucial for preserving life on Earth - until it isn't.

Anti-democratic tendencies. The issue is so urgent, in fact, that the president can't be bothered to observe constitutional niceties in solving it - he will implement drastic new regulations administratively through executive-branch agencies. In fact, his entire "plan" is a response to the administration's failure to get these kinds of measures passed by the American people's elected representatives in Congress. Early in the Obama presidency, the Democrat-controlled Congress blocked his cap-and-trade carbon-taxing scheme, prompting him to remark that there's more than one way to skin a cat. Well, this is how he's "skinning the cat." The pleas for bipartisanship that littered Obama's speech were pure disingenuousness, considering the entire effort is designed to bypass Congress and vest himself with the authority to implement these regulations directly through the bureaucracy.

Deception. In some ways it's hard to accuse the Obama administration of deception, since during his first presidential campaign Obama stated his intention to bankrupt
the coal industry. Still, the White House usually doesn't like to express its goals so openly. Shortly before his speech, a member of Obama's science advisory panel told the
New York Times, "Politically, the White House is hesitant to say they're having a war on coal. On the other hand, a war on coal is exactly what's needed." Sierra Club executive director Michael Brune understood that Obama's speech marked precisely this kind of "direct confrontation with the fossil fuel industry."

Until now, regulating carbon emissions from power plants has largely been regarded as a "nuclear option" so radical that it could be used only as a threat. In fact, as the American Action Forum notes, EPA administrators, assistant administrators, and other administration officials all denied the Obama administration was planning to do it, and
the proposal did not appear in the "Unified Agenda" of federal regulations for 2013.

Shortly before Obama's speech, the administration laid the groundwork for this move with similar secrecy, boosting the "social price of carbon" by more than 60 percent. This figure is used in government calculations about the price of regulations, meaning the higher the "price," the more beneficial regulations appear to be if they reduce carbon.  The announcement of the change was buried in a trivial new rule about microwave ovens. As Bloomberg reported, "Even supporters questioned the way the administration slipped the policy out without first opening it for public comment."

Economic dishonesty. These new regulations will entail huge economic costs as they force the shutdown of coal power plants. Instead of acknowledging these costs, Obama presented the regulations as an economic boon, asking why Walmart and other corporations would support global-warming regulations if they weren't good for business.

Although our president has vast experience as a community organizer, he seems to have little direct knowledge of the private sector and is apparently unfamiliar with
rent-seeking behavior. One example of rent-seeking would be when corporations suck up to those in power in order to influence legislation. That influence can aim to make
harmful regulations less damaging, or to shape them so they disproportionately impact the firms' smaller competitors. Obama should be familiar with this phenomenon by now, based on all the big health insurers that supported Obamacare and the tobacco corporations that supported his anti-smoking regulations.

Indeed, if these regulations are so good for business, it's a wonder corporate America is waiting for the government to mandate them instead of adopting them voluntarily. But in Obama's demagoguery, since they're good for the economy as well as the environment, no reasonable person would oppose them - to do so is to harbor " a fundamental lack of faith in American business and American ingenuity," to "bet against American workers," and to "bet against American industry."

Meaningless goals. The president's speech had all the meaningless goal-setting and numeric fixations that always accompany the cult of planning. He began by reminding
listeners of his pledge to lower America's greenhouse-gas emissions by 17 percent from their 2005 levels, as well as his accomplishments of doubling wind and solar electricity generation and doubling the "mileage our cars will get on a gallon of gas by the middle of the next decade."

Unsurprisingly, he didn't mention his most famous goals - putting a million electric cars on the road by 2015 and creating 5 million green jobs. But the fact that his previous goals proved preposterous didn't stop him from announcing new ones: ensuring the federal government consumes 20 percent of its electricity from renewable sources; doubling again our wind and solar power production; creating enough private, renewable energy capacity on public lands to power more than 6 million homes; making the
Department of Defense install three gigawatts of renewable power on its bases; and enforcing efficiency standards for appliances and federal buildings that will reduce carbon pollution by at least three billion tons.

Like a Soviet apparatchik exhorting the masses to fulfill the five-year plan, Obama explained that he expects the multitudes to join his crusade. He called on Americans to
"educate," "tell" people, "speak up," "push back on misinformation," "broaden the circle," "convince those in power," "push your own communities," "remind folks," and
"make yourself heard" on global warming. He did not overtly call on kids to inform on parents who don't observe the proper global-warming rituals, though the benefits of such actions were pretty well implied.

Picking winners and losers. Obviously, something as important as saving the world can't be subjected to the vagaries of the free market. Thus, according to Obama, "my
budget once again calls for Congress to end the tax breaks for big oil companies, and invest in the clean-energy companies that will fuel our future." In other words, his
energy sources are good and should receive government support, while traditional energy is bad and should be punished.

The problem with this kind of industrial planning is that in a large-scale modern economy, government experts cannot possess enough information to consistently make good decisions. Moreover, when the government becomes deeply involved in the economy, it enables corruption and empowers special interests that have the means to influence these decisions. One would think that Obama had learned this lesson with the ignominious end of Solyndra, Fisker Automotive, Beacon Power, A123 Systems Inc, EnerDel, and other taxpayer-supported green-energy disasters. But clearly, what Obama is promising us is more disastrous green energy loans, more useless cash-for-clunkers programs, and more ridiculous home-weatherization efforts. This is his jobs program.

Unfortunately for President Obama, the purpose of this gargantuan, economically destructive, anti-democratic campaign cannot be achieved by the means he has proposed.  America's ability to influence the global climate is nearly zero. Even if we were to exceed his utopian vision in which farmers merrily grow new fuels, and scientists sing green songs as they develop alternative power sources, and workers laugh joyously as they build windmills and install solar panels, we would not lower the temperature. Even if we were to inflict on ourselves some new Morgenthau Plan - the post-World War II proposal to deindustrialize the entire German economy - we'd have little if any impact on the weather. Obama implicitly acknowledged the futility of unilateral U.S. action against global warming when he touted the need to convince other countries to join his fight.

It's doubtful that other nations will be as willing to sabotage their own economies as Obama is to sabotage ours. And his plea for developing nations to forgo the energy
sources that form the basis of the West's prosperity, and use instead more expensive, less efficient green energy sources, is equally myopic. As we've seen in California, the relentless green crusade pushes aside all caution, common sense, and humility. Viewing mankind as a parasite blighting the planet, green extremists seek by any means necessary to reduce human economic activity. They exploit our natural urge to protect the environment, channeling these impulses toward a fanatical agenda. They have already despoiled large swathes of my native San Joaquin Valley, and the American people should understand that it is this agenda the president has in store for the nation.

Obama's 'Grand Bargain'
Tinkering with the corporate tax code isn't enough to turn around the economy.

President Obama recently offered Republicans a "grand bargain" - lowering the corporate tax rate, apparently from 35 to 28 percent, and closing some loopholes in return for new "investments" in jobs.

The economy unquestionably needs help. Unemployment is 7.6 percent and economic growth is stuck below 2 percent. But the president is offering an inadequate reform in exchange for a damaging one.

The shiny bauble Obama is holding out to Congress - the prospect of reducing the corporate tax rate by seven percentage points - isn't enough to turn around the dismal
economy. With one of the highest corporate tax rates in the developed world, the United States needs much more comprehensive reform than a moderate reduction in corporate taxes.

On the business side, I have proposed gutting the corporate tax code and switching to a consumption tax that treats all companies equally regardless of size; allows 100 percent expensing in the current year; taxes all non-expensed income at a 25 percent rate; and eliminates all credits, special deals, and loopholes. This sweeping reform would create powerful incentives for entrepreneurs to start new companies and for existing businesses to expand and hire new employees.

On the individual side, we need to cut taxes so that hard work and success are encouraged and rewarded. Perhaps equally important, the government must drastically simplify the tax code. The impossibly complex, 74,000-page federal tax code is easily manipulated by big business at the expense of smaller competitors. As detailed in recent congressional hearings, it has also become a tool for IRS bureaucrats and their political paymasters to intimidate grassroots organizations they don't like.

The price President Obama demands for his magnanimous corporate tax cut is more investments in jobs. "Investments," of course, is this administration's laughable euphemism for government spending. Having compiled an additional $6 trillion of federal debt since taking office, and having refused to reform our entitlement programs as
they careen toward insolvency, and having approved a near-trillion-dollar stimulus program that failed to improve the economy as promised, and having wasted billions more on Cash for Clunkers, home weatherizations, and other ludicrous "green" programs whose results are eminently forgettable except for Solyndra, President Obama understandably wants to begin calling spending by some other name.

But renaming spending programs won't make them work. The president is wedded to the notion that clever government planners can capably direct the economy and achieve better outcomes than the free market can. In fact, in recent speeches in Illinois and Tennessee, he outlined a new raft of spending proposals: universal preschool for four-year-olds, a "community college to career initiative," opening more "manufacturing-innovation institutes," forming "partnerships" to improve poor neighborhoods, and
"doubl[ing] down" on green fuel and electric cars.

How much would all this cost? It's hard to say - the president didn't mention a price. The only reference he made to the national debt was in accusing Republicans of avoiding discussion of the economy and "shift[ing] the topic to out-of-control government spending, despite the fact that we've cut the deficit by nearly half as a share of the
economy since I took office."

So apparently we shouldn't worry about trivialities like our $17 trillion national debt or the fact that our entitlement programs face tens of trillions of dollars in unfunded
liabilities. Some argue that these unsustainable debts drag down the economy, erode confidence in our government, depress domestic and foreign investment, and threaten the dollar's position as the world reserve currency. But according to Obama, we should trust his budgeting because of his unassailable record of fiscal rectitude.

Revealingly, a local paper, the Times Free Press, greeted Obama's arrival in Chattanooga by excoriating a stimulus-funded, $112 million federal loan made to EPB,
Chattanooga's government-owned electric monopoly, supposedly to boost energy efficiency and create jobs. EPB used the money to build a needless "smart grid" that, according to the paper, failed to improve service but succeeded in burdening EPB with hundreds of millions in debt, which will likely force the company to raise electricity prices.

This example captures Obama's entire approach to job creation - a government-centric undertaking in which the dim prospect of creating jobs is lazily cited to justify
spending hundreds of millions of taxpayer dollars in pursuit of one of the administration's ideological priorities.

It's not enough to pair the same old failed spending plans with minor tax-code tinkering. If we're going to get the economy out of its rut, we should go with a bold, comprehensive reform program that has a real impact: Revamp the corporate and individual tax codes, reform entitlements to reestablish their solvency, and cut spending to balance the budget.

Thank you, Mr. President, for your generous offer, but we'll have to decline and opt for something that actually works.
