Analyst's note:  Yet another insightful article by our friend and associate William J. Dell.  Please consider this an "absolutely must read" and carefully consider the entire original article. It is now reported that American citizens like Anwar al-Awlaki are placed on a kill list by a secret panel of senior federal officials, which then informs the president prior to the killing.  What we are seeing described here, as it pertains to killing rogue American citizens, is nothing short of murder by one who claims to be eligible to be President of the United States.  Secret assertions by the "good old boys" club of American power (regardless of political party) is NOT suitable for our government to target American citizens.  This is a watershed event with incalculably grave consequences for the future liberty and security of all Americans as we observe the beginning of tyranny.  One can only conclude that our nation is in deep trouble.  We must also remember that our federal government works for "We the People" - which means we have a responsibility to use national discourse and the law to stop this.

Our nation's baseline document known as the U.S. Constitution, both by design and content, provides for taking care of an enemy Islamist like al-Awlaki ... why are we not using it?  By what authority did we depart from being a country of Laws?  Where is the demand for extradition, the Grand Jury indictment even if Awlaki didn't show up for trial, the trial by an impartial Jury of his peers, the discovery, the confrontation of hostile witnesses, etc., etc.  Where was the courageous refusal ... in writing ... to carry out the out the unlawful order, coupled with a promise to hold those who issued the order to some future accountability before the Law?

 

 

"Anwar al-Awlaki was born in the United States on 22 April 1971 in Las Cruces, New Mexico to Yemeni parents who were present here because his father was on a Fulbright scholarship, because of this and as noted by Aljezerra, he held dual nationality as a Yemeni-American citizen. At some point he became a radicalized Muslim Imam and began a career of Jihad against the United States. On 30 September 2011, by order of President Obama, he was assassinated.

It was William Penn who said, “A good end cannot sanctify evil means; nor must we ever do evil, that good may come of it.” In the world we live in today the line of demarcation between good and evil is very murky. Political correctness has gone amok such that evil may not be allowed to be called evil because doing so may offend someone or it may be counter to a political objective. Sadly, this is also true in our Constitutional Republic.

When one reviews the actions of our elected representatives which of the following is more reprehensible or egregious in a nation based upon Constitutional principles? Is it more egregious to “torture” through “water-boarding,” or to “summarily execute” through “targeted assassination?” Is it more reprehensible to grant the Constitutional right of “due process” to the foreign detainees [enemy combatants] at Gitmo, or to deny the right of “due process” to a natural-born American with dual nationality?

Our Constitutional Republic was founded upon our unalienable rights granted by the Creator to Life, Liberty, and Property. Government, by order of its executive, does not have the authority to deprive any citizen of these rights without “due process.” In fact, we, as a nation, fought to obtain and establish these rights from an absolute monarch. How far we have slipped from the ideals and liberties given to us by our Founding Fathers.

In establishing our Constitutional Republic, our Founding Fathers created a horizontal separation of powers. They created three branches of government – the Legislative, the Executive, and the Judiciary. They did this to protect our unalienable rights granted from God. They did this to prevent any one branch, of our government, from obtaining too much power and the ability to destroy our unalienable or our Constitutional rights.

Since the beginning of the twentieth century and the birth of “progressive politics,” the progressives of both parties have been involved in the destruction of the “checks and balances” of our Constitution and the transfer of power, at this point almost absolute power, to the Executive. To compound the problem, the Judiciary has been a fellow-traveler in their effort. These guardians of the Constitution have done very little over the past 70 years to preserve the spirit and intent of the Constitution as We the People are being sold inch-by-inch by our elected representatives into the very same slavery we fought to release ourselves from during our revolutionary war era. Of a truth, if We the People, as a nation, do not awaken soon to our plight, we will one day awake to the fact that instead of a Constitutional Republic with a President, subject to the rule of law, we will have a Welfare Socialist State with a Dictator, a dictator with the capacity to take any action against any citizen without restraint.

I am very much concerned about the procedures, or lack thereof, involved in the targeting Anwar al-Awlaki. I am the first to agree that he presented “a clear and present danger” to our nation. I also agree that he needed to be taken out in order to preserve the right to Life of other citizens in this nation, both military and civilian, but without due process?

I believe there was sufficient evidence that under the Immigration and Nationality Act, as amended, al-Awlaki could have been expatriated. I believed he performed many acts which were so “inconsistent with retention of U. S. citizenship that it compels a conclusion that [he] intended to relinquish U. S. citizenship.” I believe that any Federal Judge would have come to the same conclusion and stripped al-Awlaki of his U. S. citizenship and his Constitutional right to “due process.” So why wasn’t an indictment sought by the Obama Administration? Even a “sealed indictment?” An indictment that could have been unsealed to prove and justify the action taken by the administration to target “an enemy of the State” after the completion of the military operation.

The only conclusion this writer can come too, is that it was not sought because it was counter to the political objective of President Obama and the progressives. A political objective designed to expand “executive power” and to destroy our Constitutional Republic with its rule of law. A rule of law that traditionally has said that both We the People and our elected representatives, including the President, are subject to our Constitution as the supreme law of the land. A Constitutional law that requires “due process” to deny Life to any citizen!
