"Article I. Section 8. of our Constitution has a clause which has become known as the “Commerce Clause.” This clause states that the Congress shall have power – “To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes.” [Emphasis added.] The effect of this clause is a grant of power to the federal government by We the People to regulate inter-state commerce between or “among the several States” but NOT intra-state commerce since intra-state commerce is contained within the boundary of a single State. This coupled with the Tenth Amendment which states, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people” has been a powerful check on the federal government’s intrusion into We the People’s private and personal business affairs.

An understanding of the Commerce Clause is very important for We the People. This is particularly true in the case of healthcare. The Affordable Health Care for America Act (ObamaCare) is presently before the Supreme Court. Many believe, including twenty-six States Attorney Generals, that ObamaCare violates the Commerce Clause as it requires individual citizens to purchase health insurance. This writer agrees with the States Attorney Generals’ position as explained in the following.

Regulation of insurance has always been a States Right. Each of the several States have their own Insurance Commissioners and their own rules for regulating the licencing of agents, the sale and purchase of insurance. This has been true for all types of insurance: life, fire, auto, business, and health throughout our history as a nation. This is why you must purchase new auto and home insurance if you move to another State. Your insurance is not portable across state lines and therefore is not subject to control under the Commerce Clause.

ObamaCare has a provision that REQUIRES every citizen to purchase health insurance or pay a fine. Health insurance has not and is not involved with commerce “among the several States” as the sale and purchase of ALL insurance is conducted within each State separately under their own laws and regulations. Therefore it is unconstitutional for the Congress to require We the People, individually or collectively, to purchase any form of insurance.

This past week I heard that the Republicans are drafting their own version of a national health care law to replace ObamaCare when it is repealed or declared unconstitutional. One of the provisions they are intending to place in this new law is the ability to purchase health care across state lines. On the surface this may appeal to many people because they can then shop for the least expensive insurance. But living in Pennsylvania and having the ability to purchase insurance from Arkansas has unintended consequences. Once We the People can purchase health insurance, or anything else for that matter, across state lines that purchase becomes subject to the Commerce Clause and regulation by the federal government. Is this something We the People want? Can you think of one program that the federal government has successfully managed for the benefit of We the People in the past 100 years? How about energy? Education? “Fast and Furious?” Immigration? Fannie and Freddie? Social Security? MediCare? And the list goes on!

There has been an absolute truth over the past 100 years of our national history. It is that the Socialist and Progressives, of both parties, have had no interest in managing the federal government for the benefit of We the People. Their only interest has been to manage the federal government to increase and expand their power at the expense of We the People’s Liberty. It is their over-arching desire to move our nation from a Republic to a Welfare Socialist State under an Oligarchy with them, our elected representatives (politicians), as the Rulers and We the People as their servants (slaves). Remember you cannot judge this by their rhetoric which is designed to disguise their true intent. You must view it from the cumulative results of their policies and the laws they have enacted over the past 100 years which has already made 47% of the citizenry dependent upon (slaves) the federal government.

Truly what our Founding Fathers taught is absolute, “Smaller government and closer to the people, is better government.” There are reasons for this. First, We the People [the Rulers] can keep a better watch on what is being done. Second, what makes sense economically, environmentally, socially, etc. in little Rhode Island and the Northeast may NOT be the best course of action for Texas and the Southwest. Just a small illustration. It makes no sense to drive a car at 75 mph on the twisty, curvy roads of the Northeast and it makes no sense to limit drivers to 55 mph along the wide open roads of the Southwest. It also makes no sense to universally apply “social safety net payments” across a nation where cost-of-living requirements are so varied from state to state and location to location within the several States. These things are best handled by the several States as set forth in the Constitution and the Tenth Amendment of the Bill of Rights.

When any branch of the federal government seeks to increase its control by usurping powers NOT granted by We the People in the Constitution our freedoms are eroded a little more and tyranny tightens its chains around an uninformed and unsuspecting populace, We the People. I for one believe that I know how to manage my affairs better than the Congress or the President.

Isn’t that why our Founding Fathers spelled out in the Declaration of Independence our unalienable rights from God to Life, Liberty, and the Pursuit of Happiness? Rights that are granted by God and not government! Isn’t that why our Founding Fathers and their compatriots fought to obtain our Liberty from a tyrannical King George III and his Parliament? Isn’t that why they gave us a Constitutional Republic based upon written law rather than a democracy? Isn’t that why the Bill of Rights was added to our Constitution to protect We the People from intrusion and tyranny by our own federal government and to protect our Freedoms granted by the Constitution?

We the People [the RULERS] need to be aware of and consider the unintended consequences that can result from laws enacted by our State and Federal elected representatives [our SERVANTS]. “The price of Liberty is eternal vigilance” and We the People, individually and as a nation, need to understand and accept our individual responsibility as citizen voters to Liberty’s preservation.
