Our United States Constitution is correctly seen as a bridle on our federal government and the American people hold the reins. Members of the Supreme Court are vested ONLY with authority to interpret the law. ONLY Congress is entrusted by the American people to make laws and, in so doing, Congress is directly accountable to the American people.
The Supreme Court has absolutely no constitutional authority to rewrite statutes as they did yesterday with Obamacare. Obamacare is a requirement to buy health insurance and it levies a “penalty” on those who refuse. It is true that the Supreme Court recognized that Congressional authority does NOT extend to forcing Americans into an act of commerce. Sadly, the Supreme Court then proceeded to modify an existing statute that contained a “regulatory penalty” and called it instead a “tax.” That action approved an unauthorized “tax” to be imposed on the American people. If one violates the requirement of a law, the individual may receive a penalty – but NOT a tax. Remember that only Congress can tax.
To say that the individual mandate imposed by Obamacare is merely imposing a tax, is to rewrite the existing law as opposed to simply interpreting it. With what amounts to judicial tax-writing, Justice Roberts has actually brought shame on the Supreme Court and has failed the American people. We are constantly reminded that ignorance of the law is no excuse. We give no quarter to the continuance of what can only be seen as power-hungry judiciary who are encouraged by some to believe that their views wield absolute power. A small group of men and women who don black robes and make decisions beyond their authority is disenfranchising the will of the people and will not be tolerated. It would also be good to remember that revolutions have been fought over less. The American people will not allow the Supreme Court to destroy America. It is a myth that they are somehow imbued with greater insight, wisdom, and vision than the rest of us.
Our Constitution requires taxes to originate in the House of Representatives (Article I, Section 7, Clause 1 – Also see Federalist 58). We the American People understand where this power belongs and we have long understood that the power to tax is the power to destroy. Our U.S. Constitution gives the American people the right, authority and requirement to watch and control very carefully … and quickly … those whom we place in office. We have far less control as to who is on the Supreme Court, and replacing what are supposed to be well-trained justices takes a life-time. Thus our Founding Fathers were wise in giving the authority to write laws ONLY to the House of Representatives. So we say to those of you who have been sent as our representatives to stand tall and do your duty … or you will be replaced.
