We feel certain that the U.S. House will vote on a mandatory E-Verify bill this year. The only real question is whether the vote can happen this summer (to bring faster relief to unemployed Americans) and how many of the jobs currently held by illegal aliens will be opened up, and how fast.

SAVE ACT PROVISIONS WOULD PUT THE MOST AMERICANS BACK TO WORK

Because the SAVE Act has a number of top quality provisions that we want in any bill that comes to a vote, it is most imperative that Members of the House Judiciary Committee see broad co-sponsorship of the SAVE Act.

I am especially appreciative of the SAVE Act's insistence on not just keeping illegal aliens from being hired in the future but in moving existing illegal aliens out of the jobs they already hold.

Despite the Supreme Court victory, states are allowed only to require employers to E-Verify NEW workers as they are hired. They are prohibited from mandating a check on the illegal workers who are already on the job.

But the national SAVE Act would open up not just new jobs but existing jobs to unemployed Americans.

The SAVE Act also has an excellent system of "Multiple-Workplace Notification" that will let American workers know when their identities have been stolen and are being used by illegal aliens to obtain jobs.

4 REASONS MANDATORY E-VERIFY CAN PASS THIS YEAR WHEN IT DIDN'T IN THE PAST

  1. There are several reasons why the tough provisions in this bill have a great chance of becoming law this time if we mobilize enough grassroots action: Fourteen states already have some form of mandatory E-Verify law. (See our map.) The business lobby is no longer overwhelmingly opposing to a national E-Verify law because many businesses in the 14 states are becoming frustrated that their competitors in other states are allowed to hire illegal foreign workers.
  2. The Supreme Court ruling rejected the U.S. Chamber of Commerce attempt to stop states from having E-Verify laws. That means a dozen or more additional states may pass E-Verify laws next winter, furthering confusion for multi-state businesses, meaning there will be even more business interest in a uniform national law.
  3. Nancy Pelosi (D-Calif.) is not Speaker of the House. For four years, she blocked her fellow Democrat's SAVE Act because she knew it would have passed with a strong bi-partisan majority in the Democratic-controlled House. The new Speaker, John Boehner (R-Ohio) is not as pro-illegal immigration as Rep. Pelosi, but he has not been particularly enthusiastic about E-Verify. Still, he is being persuaded by his fellow Republicans that he is going to have to allow a floor vote. Strong bi-partisan support of the SAVE Act can provide the extra pressure we need to apply to Speaker Boehner.
  4. I believe we already have the 51 votes needed to pass mandatory E-Verify as an amendment to another bill in the Senate, and that we are within striking distance of the 60 votes needed if Majority Leader Reid figures out a way to require a filibuster vote on an E-Verify amendment.
